Terms and Conditions
These Terms govern access to and use of MangoFit websites, applications, APIs, devices, and related offerings (the “Services”). By creating an account, clicking acceptance, or using the Services, you agree on behalf of yourself or the entity you represent.
1. Eligibility & accounts
You must have authority to bind your organization if you register on its behalf. You are responsible for safeguarding credentials and for all activity under your account. Notify us promptly of unauthorized use.
2. License
Subject to these Terms and payment when applicable, Mangosoft grants you a limited, non-exclusive, non-transferable right to access and use the Services during the subscription or license term solely for your internal business operations. You may not resell, reverse engineer, scrape, overload, or benchmark the Services without our prior written consent except where law forbids such a restriction.
3. Customer data
You retain ownership of data you submit (“Customer Data”). You grant Mangosoft a license to host, process, and display Customer Data only as needed to provide the Services and as described in our Privacy Policy. You represent that you have all rights and notices required to share Customer Data with us.
4. Acceptable use
You agree not to:
- Violate law or third-party rights, or use the Services to harass, discriminate, or threaten.
- Attempt to bypass security, spoof credentials, or compromise doors or readers except in authorized testing.
- Upload malware, conduct penetration tests without approval, or mine cryptocurrency on our infrastructure.
- Use the Services to build a competing access-control product using our documentation or outputs.
5. Devices & third parties
Hardware may be subject to separate purchase terms, warranties, or manufacturer policies. Integrations with third-party systems are provided as-is regarding interoperability; we are not responsible for third-party failures.
6. Fees & taxes
Fees, invoices, and renewals follow your order form or in-product checkout. Unless stated otherwise, fees exclude taxes, duties, and withholding, which are your responsibility. Late payments may incur interest or suspension as permitted by law and your agreement.
7. Availability & changes
We aim for high availability but do not guarantee uninterrupted operation. We may modify features to improve security or compliance; material adverse changes will be communicated as required by your agreement. We may suspend access for risk, non-payment, or breach.
8. Confidentiality
Each party may receive non-public information from the other. The recipient will use reasonable care to protect it and use it only for the relationship. Obligations do not apply to information that is public, independently developed, or rightfully received from a third party.
9. Intellectual property
Mangosoft retains all rights in the Services, software, trademarks, and documentation except for the limited license in §2. Feedback you provide may be used without restriction or compensation.
10. Disclaimer
Except where prohibited, the Services are provided “as is” and “as available”. Mangosoft disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Physical security outcomes depend on your deployment, staffing, and environment — MangoFit is one component of a broader security program.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Mangosoft’s aggregate liability arising from the Services in any twelve-month period is capped at the amounts you paid to Mangosoft for the Services giving rise to the claim (or fifty USD if no fees apply). These limits do not apply where law requires otherwise.
12. Indemnity
You will defend and indemnify Mangosoft against third-party claims arising from Customer Data, your misuse of the Services, or your violation of law or these Terms, subject to our prompt notice and reasonable cooperation.
13. Term & termination
These Terms continue until your subscription or trial ends or we terminate for breach. Upon termination, your access ceases; we may delete Customer Data after a grace period consistent with the Privacy Policy and your order form. Provisions that by nature should survive (fees owed, liability limits, confidentiality) will survive.
14. Governing law & disputes
Unless your order form specifies otherwise, these Terms are governed by the laws of [Your jurisdiction], excluding conflict-of-law rules. Courts in [Your venue] have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
15. General
These Terms constitute the entire agreement on their subject matter and supersede prior discussions. Failure to enforce a provision is not a waiver. If a provision is invalid, the remainder stays in effect. You may not assign these Terms without our consent; we may assign in connection with a merger or sale.
